ICON Terms and Conditions
1. Definitions
Authorised Users/You: Any Solicitor, Legal Executive, Licensed Conveyancer or individual acting under the supervision of a Solicitor, working on behalf of a firm authorised by the Financial Services Authority (FSA), or registered (or in the process of being registered) on the FSA’s Exempt Professional Firms Register, to undertake insurance mediation business.
You/Your Firm: refers to the professional firm or Authorised User whose details have been supplied when registering with ICON
Isis/We: Isis Conveyancing Insurance Specialists Ltd, authorised and regulated by the Financial Services Authority. Firm Reference Number 455994
The Underwriters: Liberty Legal Indemnities at Lloyd’s (Syndicate 4472) under the Binding Authority Contract Number RNMFP0903840.
Legal Indemnities: A range of property related insurances underwritten by the Underwriters made available in ICON
ICON: A website provided by Isis enabling Authorised Users to obtain quotations for Legal Indemnities
UK Law: The Law of England and Wales or Scotland or Northern Ireland
Mortgagee: Any bank, building society or other similar lending institution
These definitions apply wherever they appear on the ICON website.
2. Permission
In registering and using ICON you agree to be bound by these Terms and Conditions at all times.
Isis hereby gives permission to any Authorised User to generate Legal Indemnity quotes using ICON.
In using ICON you are acting on your client's behalf and not as our agent. You have no authority to:
- issue any document or make any commitment on our behalf other than quotations for Legal Indemnities
- reproduce ICON or any part of it
- modify translate or adapt ICON or its documentation in any manner
- reproduce logos or devices other than on documentation produced by ICON.
3. Regulatory
It is the Authorised User’s responsibility to ensure that:
- all information you receive from any party and in relation to any quotation obtained, must be accurate and full, to the best of your knowledge
- the ultimate policyholder (including any interested Mortgagee) is fully informed of the contents of the Policy Summary before conclusion of the contract. This document provides important information and guidance, which should be understood by any persons with an interest in the proposed insurance contract, including how to make a complaint in the event that they are not satisfied in any way. The Policy Summary and a specimen policy will be produced with each quote
- any Legal Indemnities ordered by you contains the correct risk details and that the cover ordered is appropriate for your client's demands and needs
- the ultimate policyholder is fully aware of the Policy Terms and Conditions including any applied Warranties or Exclusions and the application of UK Law.
4. Payment
You/Your Firm are responsible for payment of all insurance premiums (including Insurance Premium Tax payable) for insurance policies purchased through ICON.
The following is dependent on whether You/Your Firm:
- pays by each individual policy ordered, or
- has been approved to pay by monthly account
a. Individual policy – Payment should be made by either cheque, or electronically (by BACS or CHAPS) direct into our bank account. Payment should be sent to Isis within 10 working days of the date of ordering the policy
b. Monthly account – A monthly statement will be generated and emailed to You/Your Firm by Isis at the end of each month, detailing policies ordered and the premium due. Payment should be sent to Isis within 14 days of the end of the previous month. In ordinary circumstances, payment should be for all policies ordered during the previous month. For example - payment for all policies ordered during June, should be sent to Isis on or before the 14 July. Any extraordinary circumstances delaying payment should be brought to the attention of Isis at the earliest opportunity.
A statement detailing policies ordered and the premium due (including Insurance Premium Tax), can be accessed by You/Your Firm’s designated ‘Accounts Administrator’, via the ‘Accounts Administration’ area of ICON. Payment should be made by either cheque, or electronically (by BACS or CHAPS) direct into the Isis bank account.
In the event that the insurance premium for any policy ordered is not paid in full within 30 days of the due date as detailed in 4(a) and 4(b) above, we reserve the right to cancel the insurance.
5. General
- We reserve the right to amend, suspend, withdraw or cancel the ICON facility at any time
- We reserve the right to request further information from any ‘Authorised User’ for auditing purposes
- Due to the nature of the channels of representation, ‘in-house’ solicitors are unable to issue policies using ICON. If you are an ‘in-house’ solicitor and would like to arrange a Legal Indemnity policy, please call us on 01603 761515 where one of our underwriters will be happy to help
- You are responsible for using adequate security measures to prevent unauthorised access to ICON and shall notify us promptly if you become aware of such access. You will indemnify us against any loss caused by unauthorised use of ICON by Your Firm
- We reserve the right to amend these conditions at any time. Notification of any changes will be by email so that you can confirm whether or not you agree to the current Terms and Conditions before further using ICON
- These Terms and Conditions shall be governed by UK Law
- ICON allows others from Your Firm to register, using some of the contact details added by a previous registrant. To enable this, we will display a limited amount of Your Firm’s details during the registration process.
